USA - Law and executive disorder
On 20 July 2007, President George W. Bush issued an executive order determining
that Article 3 common to the four Geneva Conventions of 1949 "shall apply to a
program of detention and interrogation operated by the Central Intelligence
Agency" (CIA). "I hereby determine", the President stated, that the CIA program
"fully complies with the obligations of the United States under Common Article
3", provided that "the conditions of confinement and interrogation practices of
the program" remain within the limits set out in the executive order.
Common Article 3 reflects customary international law applicable in armed conflict. Like international human rights law, which is applicable at all times, it requires fair trials and prohibits, among other things, torture and cruel treatment. Common Article 3 also explicitly prohibits "outrages upon personal dignity, in particular, humiliating and degrading treatment".
